Terms and conditions of use of the Portal

The Portal https://www.numeroblu.it (hereinafter referred to as the “Portal” for brevity) is owned by NUMERO BLU SERVIZI S.P.A., Registered and administrative office in Via Monte Carmelo, 5 – 00166 Rome, P.IVA/C.F./R.I. RM 08898571008 – R.E.A. 1125501, Share Capital: 120.000 Euro fully paid up, which also manages it as the Data Controller – and Art. 24 et seq. of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter also the “Regulation”) – of Users navigating within it and/or accessing the following Sections:

“Reserved Area”, for consulting the Qualitative Reports of the CRM Applications and the Telephone Quantitative Reports of the Service;

“Careers”, for sending job requests;

“Contact us”. for sending messages and communications.

The Portal is informative in nature. Access to it is free, except for the Sections for which it is necessary to have authentication credentials; and the use of its contents is subordinate to the full respect of the present Legal Notes, which are understood to be accepted, without reservation, with the vision, access and use of the Portal.

The Legal Notes also apply to all the Services provided on the Portal to Users through connection or access to the same. If the User does not intend to accept these Legal Notices, he/she is requested not to use the Portal and not to download any material from it. Any unlawful or improper use of the data or information contained therein will be prosecuted to the full extent of the law.

Changes

NUMERO BLU SERVIZI S.P.A. reserves the right to amend these Legal Notes at its own discretion, publishing the new version on the Portal. The use of the Portal shall be understood to be subject to the acceptance of these Legal Notes, as applicable from time to time.

Limitation of liability

The information contained in this Portal may be technically inaccurate or vitiated by typographical errors. The information may be modified or updated without prior notice. NUMERO BLU SERVIZI S.P.A.. may also improve, change or eliminate certain Sections of this Portal without prior notice. In this respect, NUMERO BLU SERVIZI S.P.A. accepts no liability for errors or direct or indirect damages to Users or third parties due to the interpretation or use of the content, materials or documents published on the Portal, except in the event of wilful misconduct or gross negligence.

NUMERO BLU SERVIZI S.P.A. undertakes to use the best technology it is aware of and the best resources at its disposal to provide the Services on the Portal.

NUMERO BLU SERVIZI S.P.A. cannot, in any way, be held liable for any damage that may be caused and/or derived from downloading operations carried out for any reason of files available on the Portal’s pages. Therefore, it cannot be held liable for any and all damage caused by the erroneous, pernicious or unauthorised use of the material contained on the Portal.

NUMERO BLU SERVIZI S.P.A., has a periodically updated computer security system. NUMERO BLU SERVIZI S.P.A. cannot therefore be held responsible for the transmission of malware, Trojans, viruses, worms, ransomware, scareware, keyloggers, backdoors/bots, adware, spyware and other harmful software that may infect the computer equipment used by the User of the Portal.

NUMERO BLU SERVIZI S.P.A. does not guarantee continuous and uninterrupted access to the Portal and its Services. In the event of an interruption, it undertakes to reactivate the Portal as soon as possible.

NUMERO BLU SERVIZI S.P.A. declines any responsibility for any possible claims related to the impossibility to use the Services eventually provided, including the access to the Section “Clients Area”, “Careers”, “Contact Us” for any reason.

NUMERO BLU SERVIZI S.P.A. will not be responsible for damages, claims or losses, direct or indirect, deriving from the failed and/or defective functioning of the Users’ electronic equipment. NUMERO BLU SERVIZI S.P.A. shall not be held in default of its obligations nor liable for damages resulting from the failure to provide the Services due to the malfunction or failure of the electronic means of communication due to causes beyond its foreseeable control, including but not limited to fire, natural disasters power failure, unavailability of telephone connection lines or other network service providers, malfunctioning of computers and other electronic devices, even if not an integral part of the Internet network, malfunctioning of software installed by you, as well as the actions of other Users or other persons with access to the network.

Intellectual Property

The contents of the Portal pages are Copyright © of the company NUMERO BLU SERVIZI S.P.A.. The contents of the Portal pages cannot be copied, reproduced, transferred, uploaded, published or distributed in any way, in whole or in part, without the prior written consent of NUMERO BLU SERVIZI S.P.A., except for the possibility of storing them in your own computer or printing extracts from the pages of this Portal for personal use only. Any unauthorised variation, counterfeiting or use, in whole or in part, of the material contained in the Portal is prohibited. All the material on the Portal, including, by way of example, all the texts, software, HTML-/Java-Flash-codes, photos, videos, graphics, music and sounds are protected by copyright, intellectual and industrial property rights owned by NUMERO BLU SERVIZI S.P.A.

The downloading, as well as the use of the contents, material and Services of the Portal is only permitted for private and non-commercial purposes, in accordance with the provisions of the law. The trademarks and logos appearing on this Portal are the property of NUMERO BLU SERVIZI S.P.A.. All rights are reserved. They may not be used on any Internet Portal other than the Portal without the prior written consent of NUMERO BLU SERVIZI S.P.A.

Users Obligations

The User undertakes to use the Portal with diligence and good faith, respecting these Legal Notes in such a way as not to compromise the stability, security and quality of the Portal services. The User undertakes not to: (a) use programs or other automatic or manual mechanisms to monitor or copy the Portal’s web pages or their content without the express written authorisation of NUMERO BLU SERVIZI S.P.A.; (b) use any mechanism, software or procedure that may interfere with the correct operation of the Portal or any transactions concluded on the Portal; (c) perform any action that may cause an unreasonable overload of the technological infrastructure and system activities.

The User also undertakes not to use the services of the Portal for unlawful purposes and not to violate in any way all applicable national and international rules and regulations. The User also undertakes to comply with the Netiquette rules available at http://www.nic.it/NA/netiquette.txt.

Indemnity

The User acknowledges that he/she is solely and exclusively responsible for the activities carried out through the Portal or directly or indirectly referable to him/her, and in particular, that he/she is responsible for the contents and communications inserted, published, diffused and transmitted on or through the Services of the Portal. Therefore, NUMERO BLU SERVIZI S.P.A. cannot be held liable in any way for criminal, civil and administrative offences committed by the User through the Portal.

The User undertakes to indemnify and hold harmless NUMERO BLU SERVIZI S.P.A. from any action, request, claim, cost or expense, including reasonable legal expenses, that may be incurred by the latter due to the User’s failure to comply with the obligations undertaken and the guarantees provided and in any case connected to the use of the Portal by the User.

Furthermore, the User accepts full responsibility for the content of any messages and texts sent on the Portal and accessible to a multiple number of Users, acknowledging the User as being solely responsible and releasing NUMERO BLU SERVIZI S.P.A., as well as any subjects linked to or controlled by the latter, its representatives, employees as well as any partner of NUMERO BLU SERVIZI S.P.A. from any consequent request for damages or compensation and reimbursing NUMERO BLU SERVIZI S.P.A. of all costs arising from third party claims or actions against it for damages caused by the User or persons authorised by the User to access the Services, as well as any burden, damage, cost expenses (including legal expenses) and/or prejudicial consequences due to the illegitimate or non-compliant use (including the hypothesis of slight negligence) of the instructions received and any applicable procedures of the password and/or username, even if the illegitimate use of the password and/or username occurred before the theft and/or loss of the same was reported to the public authorities and to NUMERO BLU SERVIZI S. P.A

Communication of personal data

In order to forward any job requests, in the “Careers” section, send messages, in the “Contact us” section, it is necessary to fill in the “screen” that will appear on the screen.

To carry out this compilation, NUMERO BLU SERVIZI S.P.A.. requires the User to provide some personal data. The processing of such data by NUMERO BLU SERVIZI S.P.A.. is carried out according to the methods described in the ‘PRIVACY POLICY’ in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter also the “Regulation”), and Legislative Decree 196/03 “Personal Data Protection Code”, which precedes the registration procedure. The User undertakes to declare his personal data up-to-date, correct and truthful. Furthermore, the User undertakes to promptly update his registered data so that they are constantly complete and true.

In particular, the User undertakes not to enter, and not to allow third parties to enter, contents which violate privacy, copyright and intellectual property rights, or contents which are pornographic, blasphemous or offensive, or which could in any way damage or endanger the image of third parties or of NUMERO BLU SERVIZI S.P.A. Furthermore, the User undertakes not to commit acts of computer piracy through their Internet access.

Interruption of Services

In cases of particular gravity and urgency, NUMERO BLU SERVIZI S.P.A. reserves the right to suspend or interrupt the supply of the Services provided on the Portal, both in the specific “Client Area” section and in the other Sections of the Portal, even without prior notice to the Client and/or User, if it detects, in its unquestionable judgement and/or following a report from third parties, indices from which it appears that the way the Client and/or User uses the Service may directly or indirectly cause damage to NUMERO BLU SERVIZI S.P.A. or third parties, or compromise the stability, security and quality of the Services offered in sharing, without prejudice to the right of NUMERO BLU SERVIZI S.P.A. to compensation for damages. P.A. or third parties as well as compromise the stability, security and quality of the shared Services, without prejudice to NUMERO BLU SERVIZI S.P.A.’s right to compensation for damages.

Without prejudice to the foregoing, NUMERO BLU SERVIZI S.P.A reserves the right to suspend the Services on the Portal if, in its sole discretion or through notification by third parties, it considers that the Client and/or User violates the obligations laid down in these Conditions of Use of the service.

NUMERO BLU SERVIZI S.P.A. may interrupt the provision of the Services on the Portal, with immediate effect and without the need for prior notice, in the following cases among others

1) when updated, complete and truthful personal data are not provided by the User

2) when the Services are used for unlawful purposes or for the transmission or exchange of material that is unlawful, harassing, racist, libellous or defamatory, invasive of another person’s privacy, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable or that infringes, or is likely to infringe, the intellectual or industrial property rights or other rights of third parties which harasses, disrupts or harms minors in any way (violence, paedophilia, exploitation, etc.), or which is contrary to public order or morality; or

3) when the Portal’s Conditions of Use are violated.

NUMERO BLU SERVIZI S.P.A. accepts no responsibility for materials created or published by third parties with which the Portal has a link. Users who decide to visit a website linked to the Portal do so at their own risk, assuming the burden of taking all necessary measures against viruses or other destructive elements. Links to other sites do not imply that NUMERO BLU SERVIZI S.P.A.. sponsors or is affiliated with the entities that provide the services described on those sites.

Law and Jurisdiction

These conditions of use of the Portal are governed by Italian, European Community and international law, where applicable, and by the regulatory framework of the sector.
